Construction Agreement Clauses

  • The Contractor agrees to complete the construction of the said building strictly in accordance with the specifications mentioned in the final agreement and the approved building plan.
  • The Owner agrees to pay any additional amount that may be incurred due to variations in the work, such as additions, deviations, or use of higher-grade specifications than those originally mentioned. Such costs shall be determined by the Contractor, and the differential amount shall be paid by the Owner.
  • The Contractor agrees to complete the construction activity within period from the date of receiving the advance payment and plan approval commencing date , with an additional 6 months grace period allowed for the erection of pre-established equipment. The Contractor shall not be held responsible or liable for delays caused by natural calamities (such as heavy rains, cyclones, earthquakes, or other acts of God), riots, civil commotion, or force majeure. The Contractor shall also not be liable if any competent authority or government body revokes the building permit due to land acquisition proceedings.
  • The Owner shall bear and pay all applicable taxes including GST and other government levies as per prevailing norms.
  • The Owner shall provide borewells for water at the site as required before commencement of the work. Installation of motors shall be under the Owner’s scope. However, electrical charges and drinking water expenses incurred during construction shall be borne by the Contractor.
  • Any profit or loss arising from the execution of the construction shall rest entirely with the Contractor. The Owner or his nominees shall have no claim to challenge the accounts, expenditures, or other sums related to the project.
  • Project quality checking and progress discussions shall be carried out by the Owner or their nominees only. Engagement of third-party inspection providers, if required, shall be under the Owner’s scope.
  • If any changes other than those specified in the drawings and specifications are required, the Owner shall provide written notice to the Contractor at least 15 days prior to the commencement of such revised work.
  • The Contractor shall be absolutely responsible for site safety, security, electricity charges during construction, and site clearance.
  • In the event of any dispute arising between the parties under this agreement, the matter shall be referred to arbitration. Each party shall appoint one arbitrator, and the arbitrators so appointed shall jointly resolve the matter in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (On govt of India.)
